Questions and Answers
Just looked at my speeding picture (80 in 60 zone). 2 questions.
1. If the picture has 2 cars side by side can they be sure which car is speeding?
2. Do the cameras ever get audited? Can I ask to see a certificate showing the camera to be acurate?

Hi! I’m no expert on this, but have heard some things…
1. They usually have two cameras, one for each lane. Else they can’t tell which car was speeding.
2. Audited? Who knows, it should be though. Also it’s supposed to be used from a certain distance etc.
Yeah, I would go and ask for the certification of the camera that was used. Every camera they own has certain operating conditions which have to be met. This probably has to be verified by the camera operator when setting it up and occasionally.
Lots of fines just NEVER arrive. Or people just never get summons. I know people that don’t pay fines; sometimes they dissapear. So I guess you could wait for the summons before you pay.
Some points in General:
- The fines in the post aren’t registered letters. So there’s no proof that you ever received it. Therefore you can wait for someone to bring it to you by hand (the sheriffs office does it). Then only have you really received the fine. Till then you can just say that you never received the fines in the post. Letters can go missing you know.
- Apparantly it’s illegal to be issued a fine by post as well. It has to be done in person AND on the scene. Which basically makes all these camera fines illegal.
- Also it’s illegal to be given a fine by an unmanned camera. In other words there has to be someone by the camera who can vouch for it. I mean, if you go to court there has to be someone who represents the cops and says that he was there with the camera. This doesn’t happen and the fine gets thrown out of court.
- Another illegality I have heard of: You can’t be issued a fine on your initials. The summons and fine has to be written out in your FULL name, else it’s invalid and can be thrown out. Because there could be many people in your address with the same initials and surname I guess.
- Lastly, go to court and say: “I wasn’t the driver of the car at the time and cannot vouch for who was driving the car.” — IF the traffic photo does not show your face, there’s no proof that it was you who was driving the car. Fines are issued to drivers, not cars. You can say the car was in for service, or borrowed it to someone. That gets the fine dropped pretty quick; because it’s a waste of court resources to pursue it any more. So for photos from behind or where you can’t see the driver - they have to prove who the driver of the car was. Not quite possible. That’s why the fine has to be issued by a human on the spot.
- I read a news article once that all fines issued after 30 days after the event are INVALID. Because you can’t remember who was driving that time I guess.
I wish some lawyer would verify these things…

On a freeway with speed limit of 120 km/h fines start
at 131 km/h. Between 131 and 135 km/h the fine is R100, thereafter R100
for every 5km/h increase until 166 km/h, then it R200 for every 5 km/h until
180 km/h. Beyond 181 km/h there is no admission of guilt. The accused is
sent a notice to appear before a magistrate who will determine a fine or
jail sentence. |
In urban areas the speed limit is 60 km/h, and a
fine of R100 is payable between 71 and 75 km/h. The amount payable increases
by a further R100 for every 5 km/h above 75 km/h until 120 km/h, at which
point there is no admission of guilt option and the driver will receive
notice to appear before a magistrate. |
